1.Introduction

Zeraynce, Inc. ("Zeraynce", "we", "us", or "our") is committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, disclose, store, and safeguard information when you access or use the Atelier platform ("Platform"), including our website, web application, and all associated services. By using the Platform, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree with any part of this policy, please discontinue your use of the Platform immediately.

Scope

This Privacy Policy applies to all users of the Atelier Platform, including registered Creatives, Clients, visitors browsing public profiles, and any other individuals who interact with our services. It applies regardless of how you access the Platform — via web browser, mobile device, or any other interface we may provide.

Policy Updates

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will notify you via email or a prominent notice on the Platform. The date at the top of this page reflects when the policy was last revised. Your continued use of the Platform after any update constitutes your acceptance of the revised policy.

2.Information We Collect

We collect several types of information from and about users of our Platform, including information you provide directly, information we collect automatically through your use of the Platform, and information we receive from third parties. The categories below describe the information we collect in detail.

Information You Provide Directly

When you register for an account, complete your profile, submit an inquiry, create a booking, send a message, or otherwise interact with the Platform, you may provide us with: your full name, email address, phone number, business name, professional biography, specialty and skill categories, portfolio content (photographs, videos, design files), profile photograph, location (city/region), social media handles, bank or payment information for invoice purposes, and any other information you choose to share in your workspace.

Information Collected Automatically

When you access or use the Platform, we automatically collect certain technical information about your device and usage patterns, including: IP address, browser type and version, operating system, device identifiers, pages visited and time spent, click and navigation patterns, referral URLs, session timestamps, and error logs. This information is collected through cookies, web beacons, server logs, and similar tracking technologies as described in our Cookie Policy.

Information from Third Parties

If you choose to register or log in using a third-party service such as Google OAuth, we may receive information from that service, including your name, email address, and profile photo, as permitted by your privacy settings on that service. We may also receive information from identity verification partners (such as DIDIT) in connection with our Creative verification program.

3.How We Use Your Information

Zeraynce uses the information we collect for specific, legitimate business purposes related to operating, improving, and protecting the Platform and our user community. We will never sell your personal information to third parties for their own marketing purposes.

Platform Operations

We use your information to create and maintain your account, authenticate your identity when you log in, display your creative profile to potential clients, facilitate inquiries and bookings, send you project-related messages and notifications, generate and deliver invoices, process subscription payments, and provide customer support.

Safety and Trust

We use your information to verify the identity of Creatives applying for verification badges, detect and prevent fraudulent activity, investigate and address violations of our Terms and Conditions and Community Guidelines, enforce our policies, and protect the security and integrity of the Platform.

Platform Improvement

We analyze aggregated, anonymized usage data to understand how users interact with the Platform, identify areas for improvement, develop new features and services, conduct internal analytics and research, and optimize the overall user experience. This analysis does not identify you personally.

Communications

We may use your email address to send you transactional messages (such as booking confirmations, invoice receipts, password resets, and account alerts), product announcements, and periodic newsletters about Atelier. You can opt out of non-transactional communications at any time via your account notification settings.

Legal Compliance

We use and retain your information as necessary to comply with applicable laws, regulations, and legal obligations, including responding to lawful requests from government or regulatory authorities, enforcing our Terms and Conditions, protecting the rights and safety of Zeraynce and other users, and resolving disputes.

4.Information Sharing and Disclosure

We do not sell, rent, or trade your personal information to third parties for marketing purposes. We share your information only in the limited circumstances described below, and always with appropriate safeguards in place.

Public Profile Information

Information you include in your public creative profile — such as your display name, professional bio, specialty, location, and portfolio imagery — is visible to any visitor of the Atelier Platform, including non-registered users. You control what appears on your public profile through your account settings.

Between Creatives and Clients

When a Client submits an inquiry or a booking through the Platform, your contact details and project communications may be shared with the relevant Creative or Client as necessary to facilitate the connection. All parties are bound by confidentiality obligations under our Terms and Conditions.

Service Providers

We engage trusted third-party service providers to help us operate the Platform, including cloud hosting and infrastructure providers, payment processors, email delivery services, identity verification vendors, analytics platforms, and customer support tools. These providers access your information only to perform services on our behalf and are contractually prohibited from using it for other purposes.

Legal Requirements

We may disclose your information if we believe in good faith that such disclosure is necessary to comply with a legal obligation, court order, or governmental request; to enforce our Terms and Conditions or other agreements; to protect the rights, property, or safety of Zeraynce, our users, or the public; or to detect, prevent, or address fraud, security vulnerabilities, or technical issues.

Business Transfers

If Zeraynce is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Platform if such a transfer occurs and your information becomes subject to a different privacy policy.

5.Data Retention

Zeraynce retains your personal information for as long as your account is active or as needed to provide you with the Platform's services. We also retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes.

Account Data

If you close your account, we will delete or anonymize your personal information within a reasonable period, typically 30 to 90 days. Certain residual information may remain in our backup systems for up to 12 months. Note that information shared publicly on the Platform (such as portfolio content visible to third parties before account deletion) may persist in cached or archived copies maintained by third parties.

Financial Records

Invoice records, payment history, and transaction logs may be retained for longer periods (typically 7 years) as required by applicable tax and accounting regulations.

Anonymized Data

We may retain anonymized, aggregated data derived from your use of the Platform indefinitely for internal analytics, product improvement, and business intelligence purposes. This data cannot be used to identify you personally.

6.Cookies and Tracking Technologies

Atelier uses cookies and similar tracking technologies to provide a functional, secure, and personalized experience on the Platform. Cookies are small text files placed on your device when you visit our Platform. For a full explanation of how we use cookies, please read our Cookie Policy.

Essential Cookies

We use strictly necessary cookies to authenticate your session, maintain your login state, and protect the Platform from security threats. These cookies cannot be disabled without compromising Platform functionality.

We use analytics cookies to understand how users navigate and use the Platform. This helps us identify popular features, diagnose technical problems, and make data-driven improvements. You may opt out of analytics cookies through your browser settings or our cookie preference center.

7.Data Security

Zeraynce takes the security of your personal information seriously and implements appropriate technical and organizational measures to protect it against unauthorized access, disclosure, alteration, or destruction. Our security practices include encrypted data transmission over HTTPS/TLS, encrypted data storage at rest, access controls limiting employee access to personal data, regular security audits and penetration testing, and secure authentication protocols.

Limitations

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the internet or electronic storage is 100% secure. Incident Response

In the event of a data breach affecting your personal information, we will notify you and applicable regulatory authorities as required by applicable law, promptly and within the legally required timeframes.

8.Your Privacy Rights

Depending on your jurisdiction, you may have certain rights regarding your personal information. Zeraynce respects these rights and provides mechanisms for you to exercise them. To exercise any of the rights described below, please contact us at privacy@zeraynce.com.

Right to Access

You have the right to request a copy of the personal information we hold about you. We will respond to your request within 30 days and provide your information in a structured, commonly used, machine-readable format where technically feasible.

Right to Correction

You have the right to request that we correct inaccurate or incomplete personal information about you. Many of your profile details can be updated directly through your account settings.

Right to Deletion

You have the right to request deletion of your personal information, subject to certain exceptions (such as information we are legally required to retain). Account deletion can be initiated from your account settings, or by contacting our support team.

Right to Data Portability

Where applicable, you have the right to receive a copy of your personal information in a portable format and to transmit that information to another service provider.

Right to Object

You have the right to object to our processing of your personal information for certain purposes, including direct marketing. You can manage your communication preferences through your account notification settings.

Right to Withdraw Consent

Where we process your personal information based on your consent (for example, to send marketing emails), you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

9.Children's Privacy

The Atelier Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us immediately at privacy@zeraynce.com. If we discover that we have collected personal information from a child under 18 without parental consent, we will take prompt steps to delete that information.

10.International Data Transfers

Zeraynce operates globally and may transfer your personal information to countries outside of your country of residence, including countries that may not have the same level of data protection as your home country. When we transfer personal information internationally, we rely on appropriate safeguards such as standard contractual clauses approved by relevant regulatory authorities, adequacy decisions, or other legally recognized transfer mechanisms to ensure your information remains protected.

11.Third-Party Links and Services

The Platform may contain links to third-party websites, services, or social media platforms that are not operated by Zeraynce. This Privacy Policy does not apply to those third-party services. We are not responsible for the privacy practices or content of third-party sites and strongly encourage you to review the privacy policies of any third-party services you access through links on our Platform.

12.California Privacy Rights

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect and how it is used, the right to delete your personal information, the right to opt out of the sale or sharing of your personal information (we do not sell or share personal information as defined by the CCPA), and the right not to be discriminated against for exercising your privacy rights.
